US DOJs Adani Case Dismissal on Track, Says Senior Advocate Pahwa

NEW DELHI, June 29 — A senior Indian lawyer says the U.S. Justice Department’s bid to drop the indictment against Gautam Adani and seven other executives remains firmly on track, dismissing a judge’s request for more information as a routine procedural step that changes nothing.

Senior Advocate Vikas Pahwa told ANI on Monday that U.S. District Judge Nicholas Garaufis has simply asked the DOJ for additional material before issuing a final ruling. The judge has listed the matter for July 13 after granting a short adjournment, Pahwa said.

“This is a routine issue. The judge, while considering the application, has asked for some additional information and fixed the matter after a short interval. That is a completely normal judicial procedure,” Pahwa said.

The scene inside the New Delhi legal circles is one of calm confidence. Pahwa stressed that the court has not rejected the government’s request to dismiss the indictment. Instead, it followed standard legal process by seeking further clarification.

“The court has not rejected the application for cancellation of the indictment. It has only issued a notice, sought additional information and fixed the matter for July 13. Once the reply is filed, the court will consider it and pass an appropriate order,” he explained.

Pahwa grounded his analysis in the U.S. Federal Rules of Criminal Procedure, specifically Rule 48(a). Under that rule, the discretion to seek dismissal of an indictment primarily lies with the government.

“The government has the authority to seek dismissal of an indictment, subject to obtaining the leave of the court. That is exactly what has been done in this case,” Pahwa said.

By nightfall, the interpretation from legal experts here was clear: this is a pause, not a reversal. The DOJ’s request remains alive, and the July 13 hearing will be the next milestone.

The case has drawn international attention as it involves one of Asia’s richest men and allegations that have cast a shadow over the Adani Group’s global ambitions. For now, the U.S. court system is moving at its own pace, and the judge wants more paperwork before he signs off. But as Pahwa sees it, that is just how American courts work.
